Interstate Practice Applying for a barrister's practising certificate
Disputes, complaints & discipline   Professional Conduct

All complaints about a barrister in NSW must be referred to the Office of the Legal Services Commissioner. Although the Commissioner is entitled to investigate complaints, he generally refers complaints about the conduct of barristers to the Council of The New South Wales Bar Association and the investigation of complaints about solicitors to the Council of the Law Society of New South Wales.

Part 10 of the Legal Profession Act governs the manner in which, and the necessary processes required for, the investigation of complaints about barristers and solicitors.

Complaints about an interstate barrister but in connection with their practice in New South Wales can also be referred to Office of the Legal Services Commissioner. However, if more appropriate, the matter can be referred to the regulatory authority of the barrister's home jurisdiction.
