Privacy statement

Information held by the New South Wales Bar Association about its members and holders of New South Wales Barristers' Practising Certificates is collected, stored, used and disclosed in accordance with the Privacy Act 1988 (Cth). The Association is committed to uphold the National Privacy Principles contained in the Act.

Collection and use of personal information

Holders of Practising Certificates
The Bar Association collects and stores information on holders of practising certificates pursuant to the Legal Profession Act 2004 and the Legal Profession Regulation 2005. Information provided by holders of practising certificates is recorded in the Association's register of local practising certificates kept in accordance with section 106 of the Legal Profession Act.

Section 106 of the Legal Profession Act 2004 requires the Association to keep a register of holders of local practising certificates, which must be available for inspection at the Council's office.  Only that information required to be included on the register is able to be viewed.

The Associaiton may also 'publish, in circumstances which it considers appropriate, the names of persons kept on the register, and any other information included in the register concerning those persons.'

Each year, the Association provides the Attorney General and Law Society with the contact details of every barrister who holds a New South Wales practising certificate for the purposes of the Law Almanac and Law Society Diary publications. The details provided include the barrister's name, business address (including DX), phone and fax numbers, date of commencement of practice (in the case of the Law Society Diary), and other jurisdictions in which the barrister is admitted (in the case of the Law Almanac). The Association also provides barristers' practice contact details to members of the public on request. In these circumstances, the Association provides only the business details requested, which may include practice areas, other languages spoken and other jurisdictions in which the barrister has been admitted as advised by them.

 

The Association must also in certain situations provide information as required by the Legal Profession Act to the Legal Services Commissioner and corresponding authorities in other jurisdictions e.g. s121. It must also publicise disciplinary action pursuant to Part 4.10 of the Legal Profession Act.

Members of the Association
Membership of the Association is voluntary. Information provided by members is recorded in the Association's membership database kept in accordance with section 30 of the Registered Clubs Act 1976. The information collected enables the Association to provide members with services and benefits.

'Find a Barrister' Webpage
If a member holds a current practising certificate, unless they have requested otherwise, their practice contact details and other information relating to their practice appears on the Association's 'Find a Barrister' webpage contained on this website. This search facility does not contain any confidential information and it enables members of the public and solicitors to search for a barrister suited to their particular need.

Legal Referral Assistance Scheme
The Bar Association's Legal Assistance Referral Scheme collects information from individuals who seek legal assistance. These individuals are advised as to why certain information is requested and the manner in which that information will be used and disclosed.

Security
The Bar Association is committed to keeping private information held on individuals, electronically or otherwise, secure and has always maintained appropriate security measures and technology to ensure that information is protected. The Association regularly reviews and when necessary will update its security measures to ensure all data held is secure.

Sharing information
Unless authorised by the Legal Profession Act, or some other Act, or the individual to which the information is held (specifically or impliedly), the Association does not share or publish information to third parties about its members, holders of practising certificates, or applicants to the Legal Assistance Referral Scheme.
